With the exception of Louisiana(which has some rather unique property laws)there are " title-holding " states and " non-title holding " states when it comes to automobiles. Texas is a " non title-holding " state so the original title will be in the possession of the lienholder(if there is a lien outstanding)and the borrower recieves a " non-negotiable " title until such time as the lien is satisfied. Such is the procedure for new or used vehicles here under the Lone Star. You referred specifically to a used car that you want to buy so the seller should be able to provide an original title with the space provided for any prior lien's release being signed, dated and (hopefully) notarized. If you are concerned about any UNDISCLOSED liens on the vehicle/title, have your state's department of motor vehicles run a title search/license plate check BEFORE you hand over any money to the seller. For a few bucks you'll have the complete title history of any vehicle registered in your state.
