If you are not satisfied with the insurance companies, then you will have to go to court, which can be very time consuming and expensive, especially if you loose. Sometimes, you can just sue the other person for the amount that the 20% comes to in small claims court. Are you sure that what the witnesses and the other driver told you are what they told the police and the insurance investigators? Often they are not the same. Insurance companies want to pay as little as possible, and if they even think they can save 20%, they will try it.
