no, he cannot, you must go to court, get a lawyer or legal aid, how did he get custody of your 15 yr old, I hope this was done through the court system, YOU MUST GET LEGAL HELP! Can he do this? Yes. Can he do this legally? Perhaps. Can he do this without a court order? No. That he has custody of your 15 year old, indicates something: either you voluntarily gave custody up to him, or it was ordered. If the custody was decided mutually between you, then the same would have to happen with your 9 year old. If, however, the custody of your 15 year old was awarded by the court to protect the child, a judge could rule with you inabstentia awarding custody of the 9 year old sibling to his father based on nothing more than the ruling on the 15 year old.
