Unfortunately, the deletion of overtime or failure to properly pay overtime is one of the most common wage and hour labor violations in the United. The Fair Labor Standards Act (FLSA) requires non-exempt employees to be paid at least 1.5 times their normal wage for all hours worked over 40 in a defined work week. Several states have slightly varied regulations (i.e. overtime for work over 40 hours in week OR 10 hours in a day).
Since it seems you that you have reason to believe that wage and hour fraud is being conducted I would recommend the following action to you.
1.) Ensure that you are not covered under the waiter, IT, or hospitality/seasonal amusement portions of the FLSA.
2.) Maintain an accurate daily calendar with your hours worked. This should be completed the same day in pen and initialed. Sometimes this is an enough of a deterrent. This may be retroactive, but those dates should be noted separately.
3.) Contact your state Dept. of Labor's (DOL) Wage & Hours division. If your state does not have a DOL (i.e. Texas), then contact the US DOL Wage & Hours division. Link #1 provides a list and website of all state DOL's.
