The person is either super lucky, they know where the "safe zones" are, the pimp or the person soliciting pays off a police officer. It's a tough life and a dangerous one.

If a prostitute (male/female) is arrested for soliciting they are not usually kept long before they are either bailed out or let out of jail. The police have too many other serious crimes to deal with and jails/prisons are full to the hilt.

They get money first, saying it is in return for companionship. Sex develops out of this arrangement, but was not paid for.
