A petition is made to the family court and a hearing is held. Parent(s) can relinquish their rights so the child can be adopted or made a ward of the state. But unless the child is adopted the parent(s) will not be relieved of their financial obligation. Even if the child is in foster care, the state has enforcable laws to make the parent(s) pay child support. What if both the parents agree to the father giving up his rights. They were never married and his has not ever given anything monetary or even seen the child personally for 5 years. The mother has been raising the child herself. A form was written up by both parents and notarized for the father to give up his rights. What would be the next step to make this complete and is this possible since the mother does not seek any child support from him for the raising of the child.

Realize there was a reason it happened, straighten up your life and be patient for the time to pass so they can see you really have improved your life.

During this process... you need to have "broad shoulders", and ask yoruself the hard questions... like "Wouldn't it have been a whole lot easier to fix my life before and not have my rights terminated in the first place?"

Hint: bringing up children has a lot to do with serving someone for no financial or material gain on your part.. it is done for love and only love. I would suggest doing some volunteer work at a retirement home, war veterans home, or help the homeless organisations. Why? This is also about serving people for no financial or material gain. It also will answer a question for you; If you cannot stand doing this/ refuse to do it... then that is most likely why you have had your rights terminated in the first place, and that's ok, parenting is not for everyone, its only a moment of being honest with yourself.

Above all... you need to be brutally honest with yourself. Whining or complaining why this or that happened in your life will never achieve your rights being reinstated... ever.

It is possible to regain custody after rights have been terminated. However, this includes a very long court battle and is not usually beneficial to the child who has been living with his or her adoptive parents.

Is there a way to get your kids back after rights have been terminated?

That depends on a lot of factors including why rights were terminated, if the termination was voluntary or involuntary, the length of time that has passed since rights were terminated, the nature of the changes that have occurred since rights were terminated and if the child has been adopted in the interim. You really need the advice of an attorney specializing in family law in your state of residence for more specific information regarding whether or not you would have a valid and viable case.

Yes. You must pay until the child support order has been terminated by the time set forth in the order, or terminated by the court. Even if the order is terminated you will still owe any arrearages.

In KY if your parental rights were terminated four years ago against your wishes All of a sudden you have been petitioned to appear in court to pay child support can the courts do this?

Even if your parental rights have been terminated, your obligations do not necessarily end at the same time. The state of Kentucky can compel you to pay child support, even though you are not allowed to visit your child. Many times a good family court lawyer can help you with such a situation, especially if you want to regain your parental rights.

Can Oklahoma DHS legally adopt a child out if they have been in their custody for a year?

The issue isn't how long they've been in custody. Once the parental rights have been terminated (TPR - termination of parental rights), the child is eligible for adoption. If the children have not been TPR'd then they are not eligible for adoption.
