you have to file a petition with the governing probate court citing the reasons that you belive the child should be placed into your custody. If you already have possession of the grandchild by permission of the parent(s) you will have a much easier road ahead of you!

If you want legal guardianship for your brother you must petition a court to arrange it. It frequently helps to have a lawyer write the legal documents. Social workers can help guide you through the process. Contact them. They do such things quite often.

Im 17 and I want to move out of my parents house If my parents and my aunt who im moving in with both agree do I still need a legal guardinship petition?

If I do need legal guardianship, do i get it from the state that im living in now or do i get it in the state that I'm moving to. I'm planning on moving from New York to Maryland. ---------------------------------------------------------- The purpose of granting guardianship is to allow your Aunt to sign paperwork in place of your parents, for school or for medical treatment or whatever. A hospital cannot treat you until they receive parental authorization, so the paperwork can save valuable time in an emergency. Your parents should grant temporary legal guardianship to your Aunt. The paperwork is not complicated and can be found on the internet for free (a link to one version is below). You create one copy of the document and leave a space at the bottom for your parents' signatures and for a notary statement/signature/stamp. Fill it out and have your parents get it properly notarized. Your Aunt does not need to sign it. Give the document to your Aunt. She will have to carry it with her and it will serve as her parental identification whenever requested.

Can an attorney-in-fact under a power of attorney name a successor on behalf of an incompetent principal?

No. First, the POA must be a Durable POA, executed when the principal was competent, to continue after the principal has become incompetent. If that is the case, the court must appoint a guardian if the AIF can no longer serve. Also, if the family or some other adult petitions for a guardianship of an incompetent person and the guardianship is approved- the POA is automatically extinguished.No. First, the POA must be a Durable POA, executed when the principal was competent, to continue after the principal has become incompetent.
