I was able to do this in Georgia and now my husband has adopted my son. But the father has to not have any contact with you or the child for at least 6 months, no child support during that time either. I had no problem because my ex was in prison at the time I took it to court for drugs for his third time. So all the judge had to do was look and that and the fact he never had paid any child support or contacted us in 3 years. It costed us around $1500.00. And don't let people fool you we only had to pay $700 for the adoption.

Unfortunately this happens a lot. You just have to back into the court system with records on non payment of child support. When the courts demand payment to you for child support then the ex must pay that child support. They can take it off his wages, but some men will quit their jobs or work under the table rather than pay child support. They have thus, broken the law. I can understand why you would want to do this on your own and kick your ex to the curb. These aren't men at all ... they are mainly misfits! By the way, I do believe that if a father has custody of the children then the mother should pay him child support. Same goes for her! Take the guy to court! Good luck Marcy

Depends on laws & proceedures required within your state. Find a custody lawyer in the yellow pages & ask someone local. In Michigan, you need to prove that the father is unfit or have him sign off his rights. Sometimes, if you drop the child support arrearages, deadbeat dads are more willing to consent to this. After all, they don't care about the child, only about themselves. * Termination of parental rights can only be done by the court or by the voluntary relinquishment of rights by a parent. The non compliant parent should be brought to the attention of the court through the state's department of family and children's services.

I suggest you contact your State's child support agency through the court that issued the child support order. They can take various actions to collect this support. Be persistent but patient.

A great deal depends on the law of the state so without knowing the state there is no way to answer. In some states child support cannot be terminated until the child is age 18 or over. In others, there are ways to do it, but you have to give the state.
