Snow forms higher in the atmosphere where the temperature may be much colder than the air temperature on the ground. So snow can from and fall even though the ground air temeprature is above 0o celcius.

as long as the upper levels are cold enough, it can fall as snow near the surface.. Convection can cause it snow lower down also.

Yes, it can be a few degrees above freezing and still snow. Remember that snow is formed high in the clouds, where it is colder than the surface. If a snowflake falls through the air and it is only above freezing in the last minute of its journey, it will probably remain frozen.
