There is no way to know for sure. Actually, there is no evidence to suggest that any innocent person has actually been killed by the death penalty. In fact with DNA testing the chances are close to 0 that any innocent person will ever be killed by the death penalty. Since 1973, over 130 people have been released from death rows throughout the country due to evidence of their wrongful convictions. In 2003 alone, 10 wrongfully convicted defendants were released from death row.

The most current number according to The Death Penalty Information Center (www.deathpenaltyinfo.org) is 130. This only accounts for those officially recognized as not guilty and exonerated. There are others not included who have been released from death row but never officially acknowledged as not guilty of the crime.

There have been none so far. However, many people have been released from death row because they were proven innocent. Quite often, they are released only a couple days before their planned execution, which makes people worry that someday an innocent person will be put to death.
