It is difficult to answer this question, because the numbers are constantly changing. Uniforms used to be expected only in parochial schools, but today, even some public schools are experimenting with uniforms, since there is a belief that wearing school uniforms creates a sense of school spirit, inspires self-discipline, and fosters positive behavior. This is debatable, since some studies show it has a positive effect, while others show it has little if any effect.
That said, there are more than 7,000 Catholic parochial schools in the United States, all of which expect their students to wear uniforms. And a number of private schools expect a student to wear a uniform as well, especially some of the older private schools, for which wearing a uniform is a long-held tradition. One survey from 2008 estimated about 18-20% of American students attend a school where they have to wear a uniform. But other surveys have offered figures as high as 25%.

I cannot tell you the exact anwser, but if you include private schools, i bet around thirty to forty five percent. Although they wear uniforms, must are not the traditional elementary school jumpers, but skirts and polos.

Concerning shool dress codes: the constitution says nothing about what you should wear as you use a shovel to scrape material from the ground. On the other hand, if you are referring to school dress codes, the courts generally let them stand. Basically the direction the US Supreme Court is seems to be going in allows school dress codes if they are established or authorized by an administrative body above the level of the particular school. So the rules or permission for the rules would probably need to be set above the level of the local school. At least that seems to be how it is now.
