By the constitution only 2/3rds; however fearing a break in the union, they amended and adapted the constitution until they all agreed (basically).

Article VII of the Constitution required that 9 states, not 2/3 or all of the states had to ratify the Constitution before it became effective.
The Constitutional Convention faced a problem since it had been convened to make amendments to the Articles of Confederation and the Articles required unanimous consent for all amendments. This led many delegates to believe that the proposed Constitution, being a supposed amendment of the Articles, would require ratification by all of the states.
Nevertheless, the delegates to the Convention recognized that unanimity was virtually impossible since there had already been two attempts to amend the Articles of Confederation that had failed by one vote. After much debate on how many states should be required to ratify the Constitution, the delegates settled on nine states. Nine states ratified it by June 21, 1788, and it was agreed that the new United States would begin operations on March 4, 1789. Before that date, two more states ratified it so the "United States of America" at first consisted of only 11 states. North Carolina ratified the Constitution and entered the Union on November 21, 1789. Rhode Island followed suit on May 29, 1790.
Only nine of the 13 states were required to ratify the Constitution for it to be valid. Eventually, all 13 ratified it even though they didn't have to.

The United States Constitution was written in 1787 and ratified in 1788. It has 27 amendments, but the first 10 were ratified simultaneously in 1791 so it was amended one time with ten amendments. The other 17 amendments were ratified one at a time. So the US Constitution has 27 amendments but has been amended 18 times.

The first 13 states were judged to have become US states when they ratified the US Constitution between 1787 and 1790. However, all 13 of the colonies that ratified the Constitution were already signatories to the Articles of Confederation, and therefore already states at the time, and became subject to the Constitution once 9 states had ratified it.
