The time frame depends on factors such as the willingness of the parents to compromise,other persons being allowed to testify on behalf of a parent, or persons with a legal right to submit evidence or objection to the custody petition, and so on.

It is an uphill battle. If the child is happy and well taken care of, the court will find no reason to uproot the child just to give him to you. However, if there is neglect or abuse, then you have a real case. Be sure you have your ducks in a row, (evidence) before you make accusations. The time depends on the lawyers and court system. It could take weeks, months or longer. Also, if the child is in the care of the other natural parent, then it is going to be even harder to gain custody.

First, you should consider how the child is doing where it is. Ownership of a child should not be the focus. Or, how you are better than the other parent. In the long run, it is how both parents manage to create a consistent environment to raise a responsible child.

You will have to go to court to obtain custody, if the other parent is not willing. A steady job; a decent place to live and no legal issues resulting from drugs or other arrests are a good start. Even then, it is not a sure thing.
