The answer to your question may be different in the state where you live than in the state I live in (Oklahoma) but here the perspective adoptive parents file a Petition for adoption and then either (1) ask the father if he will provide his consent by signing off on a "relinquishment" of his parental rights or (2) file an Application within the pending adoption case for the court to determine that the child is eligible for adoption without consent of the biological father.
