Minor children are not allowed to choose which parent or person with whom they wish to live. In some instances a judge will speak with a minor child if the child demonstrates the maturity to fully understand the situation.

Judges base custodial issues strictly on what is in the best interest of the child or children and not on the preferences of any of the involved parties (including the child/children in question).

  • ** Please note, that GA is the only state where the child basically gets to choose who has custody of them--unless, as stated above, the parent they choose is deemed to be unfit. In every other state, the child's wishes (at a certain age/maturity level) are considered, but the court is not required to abide by them.

18, before they can decide regardless of what anyone else says (and even then, the parent they want to live with has to agree to it).

Courts will generally listen to the child's opinion, but they're not bound by it if they think it's clearly in the child's best interest to live with the other parent.

I'm not a lawyer, but I read that in some cases 11. I know for sure the age 14. Go to child custody laws in GA.
