I can well understand this custody business is very hard on you. No one likes to see their parents split up. I suggest that you get both your parents together and discuss this. There is much more to your parent's feelings than you can ever possibly know so don't think you're mom is the bad one here and things will be better with dad. Both of your parents love you, so both should sit down with you and the three of you should discuss this problem.
No, your father will not be arrested if you went to him on your own accord. It is advisable for him to let your mother know you are there and nothing terrible has happened to you and that's what it sounds like he has done. I think you have a right to hear the truth from both your parents and thus, you will see the reasoning for the fight over you. Don't judge either parent too harshly.
