Tentatively, the child would be. However, if you were found to be speeding or doing anything else unsafe, you could open yourself up for liability.
It is the driver's fault because they should ALWAYS be on guard and attentive, even if a child runs in front of his/her car. But, if the child was un-supervised, it is a stalemate
