If a man dies in Nevada with several credit cards in his name only is his wife responsible for the unknown debts? |
[Edit] |
Answer
Possibly, even though Nevada is a community property state and all assets and debts are deemed equally owned and owed by spouses, there might be grounds for an innocent spouse defense. That can be a very difficult claim to prove especially if the couple were living in the same residence at the time the debts were incurred. It would be advisable to seek legal advice by an attorney who is knowledgable in creditor/debtor laws (bankruptcy attorney). Most offer free consultation or at minimal fees.
