If a person with no insurance hits another car from behind on the highway is there any way that the other driver can later claim injuries and sue?

Answer

Yes. And they usually do. Anyone involved in a rear end collision is at fault to one degree or another. The laws in every state say that a driver needs to be in control of the vehicle at all times. Regardless of weather conditions, the way the other guy was driving, etc.
