The answer to this would depend on if you went to court at all. If you went to court and they didn't assign custody or child support, than you are required to notify the judge and your husband but you can move out of state.. If you didn't go to court, and I doubt this occured since you do not mention an ex husband, he still has parental rights as well as you, and unless he is abusive to you or the children, it is probably best to tell him that your moving out of state, but your legally able too. I would worry about being accused of kidnapping though if the relationship ended badly, especially without custody roles being legally assigned.
You may be able to petition the court to modify your custody order which includes a request for child support going forward.
