If the husband is the main cardholder and his wife is an authorized user can she be sued for past due balance?

[Edit]

Answer

Here is advice:

  • Yes, she can be sued. Whether or not a suit would be successful is another question. As an authorized user, it is questionable whether or not the debt could even be reported against her, much less collected or sued on.

  • Being an authorized user does not automatically make a person responsible for charges on the account. It is a way for the CCC to counteract any fraudulent uses of the account. If however, you live in a community property state you are liable for the debt. Or in some cases, a state that has "living expenses" statutes.
