If the insurance company for the person at fault decides to use used parts can a person insist on new parts?

Answer

It is very important when you say the insurance company.. which company? Yours or another. Insurance companies are not in the business of using used parts per say because it can produce another liability for them. Insurance companies however in some cases do use aftermarket or cheaper products than factory, if you read your policy closely you will probably find that tucked in there. Can you insist on new parts..yes... you will more than likely hands down win that situation, unless a new part is unattainable due to sparse distribution or it is no longer manufactured.
