Same as a female custodian parent would- got to your state attorney general for help. The AG should be able to put a child support case on her, so that when she does begin working, she will owe you (the child) money for child support. Good Luck!
If the parents are unmarried and don't live together the mother should obtain a child support order since relationships of that nature tend to be unstable and it takes time to obtain a child support order. If the parents are unmarried and don't live together the mother should obtain a child support order since relationships of that nature tend to be unstable and it takes time to obtain a child support order.
Absolutely nothing. You have no control whatsoever over naming the child. You have no parental rights unless you establish your paternity in court. Once established legally as the child's father you can request a visitation schedule and the mother can obtain a child support order. The child's name is the mother's choice.Absolutely nothing. No, if the mother voluntarily gives cutody to someone else, she can no longer be paid child support because she no longer has custody of the child. What happens now is the father can obtain custody because he does have rights or the person who has custody and have legal guardianship can file for assistance in which child support can be included or filed.
The mother's right is to sole legal and physical custody of the children and the right to obtain child support for her children. Depending on her state of residence, the mother may also petition the court to have the father's parental rights terminated or request the state do the same if she cannot do it herself. Termination of parental rights does not terminate child support obligations.
If the mother knew the man was not the biological father and still attested to that fact she could be charged with perjury, a very serious offense. If the man was paying support and found out he was not the biological father he would need to obtain proof of such through paternity testing (usually DNA). He would then need to file suit against the mother of the child and present the paternity evidence in order to recover his financial loss.
I suggest you file a motion in court to declare the existence of father/child relationship. Be prepared to pay child support and confront a very angry husband!
Go to court to obtain custody and an order for support.
Who the father is a very important question. You can find that out by requesting a court ordered paternity test for the suspected father. Then you can obtain a child support order and the father can arrange visitations.
All you need to do is contact the Family court in your state and obtain the necessary paper work. Keep in mind, signing your rights does not releave you from financial responsibility/child support.
I'm not certain what "put you in child support" means. If your mother in law is, in fact, supporting your child, she could obtain a court order requiring you to contribute to the support of that child. If that's what you were trying to ask, then yes.
Child support can be obtained by the mother once the child is born and she can obtain a confirmation of paternity through the courts. The International Institute for Reciprocal Family Assistance (IIRFA) acts to intercede on paternity and child support cases when parties are from the US and Mexico. In other words, the US has a reciprocity agreement with Mexico in family matters involving children. You can read their handbook at the related link.A determined mother can pursue the case with the help of member agencies that are required to assist in the collection of child support. Governments have recognized the need to help enforce child support and states are required to have agencies that will assist a mother in her position. She doesn't need to travel back and forth from Mexico to obtain support if you are the father of her child. It will be more difficult and take longer but eventually a child support order can be issued and enforced in the US.Child support can be obtained by the mother once the child is born and she can obtain a confirmation of paternity through the courts. Both parents will give a girl an X chromosome. The father will give a Y and the mother will give an X to a boy.
