The standard in family court is 'the best interest of the child' - now let's face it, it can be a tough world out there, if the mother can provide a couch and the father is homeless, the couch will win, but if the father is capable of providing better living quarters, that would definitely be a factor. You really have to look at the totality of the circumstances.

that depends it would probaly be better to have your own room but hey maybe she could get a day bed or somthing(thats a couch that turns into a bed it depends on how much your there
