You would have to get a Doctor to confirm that you have a disibility and then talk to a lawyer that specialises in medical cases. A lawyer will tell you if you have a case or not and maybe arrange an out of court settlement. I'm no lawyer but I have a friend who just settled a case for carpal tunnel syndrome and he got $60,000 and will collect $500 a week for as long as his recovery takes.

You can ask for a settlement. Most states have a schedule or disabilities or impairment ratings that dictate how much a particular disability or permanent impairment is worth. The adjuster handling your claim will be able to tell you.
