I would answer to that question maybe, but most likely not.

In Alberta, you can legally leave home at age sixteen.

In Ontario, you can withdraw from consent at sixteen, or live with another person at 14 as long as it is safe. However, as I am sure you know, laws vary significantly from province to province (drinking age in Ontario is 19, vs 18 in Alberta, for example).

My best recommendation (and I know it sounds scary) would be to examine your reasons for emancipation, and speak with your parents about it.

If that fails, you can do another (possibly equally scary) thing. Go to a provincial court house and see if you can find a duty counsel lawyer. They can provide legal information. You may also try a legal aid clinic in Calgary. http://www.legalaid.ab.ca may provide more information on how to obtain legal aid services.

I would urge you to consult a lawyer, as leaving home before a certain age can often result in deliquency status, warrants, arrests, and possibly Children's Aid Society (or whatever the Alberta equivalent is) involvement. Also, I must urge you that if you are leaving home as a result of abuse, you should seek help from a children's welfare society.

If your parents are illegal can you be emancipated?

Another oddly phrased question. People (including parents) are not illegal, only actions can be illegal. Perhaps you mean, if your parents are criminals, can you be emancipated? The usual remedy if you have parents who are criminals, would be for you to be placed in the care of some other relative, or failing that, to become a ward of the state. Emancipation takes place for other reasons than the mere lack of a guardian. Are your parents trying to rob you of your rightfully earned money? Then perhaps you deserve to be emancipated.
