Yes. In fact, you could sue the company if they refuse. The company should compensate you in every way since the accident happened at work and you should never have lost your job, they should have hired a temp during your absense. Very unfortunate situation. You should check with an attorney about your legal rights so you don't get messed over.

You got hurt on a job 13 years ago and herniated your disk and received workmans comp for it Now you herniated the same disk at a different job can you collect workmans comp on it?

Hi~ It is my very recent personal experience that you will not be successful in receiving benefits for your new injury. They will jump on the opinion that this is a pre-existing condition. But STILL file your claim as quickly as possible! (Hopefully you either had witnesses to the injury or it occured just days or hours ago....)

Do you still receive payment for lost wages if your fired one week after your injury occurs?

It is illegal for a company to fire you after a Workmans Comp injury has been reported. Retain an injury lawyer ASAP. Good Luck

Do you have to reimburse your employer for workman's comp after you are back to work?

If it was a legitimate workplace injury and you didn't commit fraud, the money is yours. It's not a loan. The idea behind workmans comp is that if you're injured on the job you still get part of your paycheck instead of suing the company for injury.

If you settle your medical part of workmans comp claim can you still get medicaid or medicare to pay for future medical bills for same injury?

Can a person put in for a workmans comp claim if they are still continuing to work?

Yes. There are different types of workers compensation benefits available, and it might be necessary to file a claim to receive them. The employer (or its insurance company) must pay all medical bills related to a work-related injury. In addition, a person might be working reduced hours because of an injury, and might be entitled to receive temporary partial disability (TPD) payments. Finally, a person who is still working might still be entitled to a permanent injury rating based on some permanent impairment once their injury is done healing.

If you are drawing workmans comp and working at your job part Tim and workmans comp pays you the difference and you get sick and are out of work a few days will workmans comp still pay you the differ?

As each state's criteria for eligibility and amount of workman's comp payable differs, you need to contact your state's office for clarification.

You were told you have spine damage from a injury at work and would never be able to do physical labor again If you change jobs while still under the Doctors care would the Workmans Comp still cover?

The new employer would not be required to cover this injury or pay Workmens Comp as you did not sustain this spine damage while in their employ. Best advice is to sit still in present job until signed off on the injury. Usually another job that would not further complicate the issues is available within the same company. For the best difinitive answer, you may need to consult legal counsel.

Hubby has a ruptured disc in lower back and muscle and nerve damage to both legs. he's collecting a weekly workmans comp check right now can he have surgery and still collect a lump sum payment after?

Your hubby can collect the money still if he is still unable to work but if he does go back to work with no pain what so ever you would have resign from the insurance or that would be fraud

Can I still get workmans comp if it happened at work but I told them it didn't?

You will probably need to explain why you didn't tell the truth as well as why they should believe you now, and you may have gone past the time period to report your injury, but I encourage you to make your claim quickly to find out. The time period varies by state.

You are a school bus driver Will your workmans comp continue past the end of the school year if you are still unable to work?

If you are unable to work due to an injury suffered on the job, you should continue to receive pay. However, if the insurance company doctors find your injuries should not prevent you from working, they will stop paying.

If your fired one week after receiving an injury that is covered on workmans comp do you still receive payment for the lost wages for the time your not able to work due to the injury?

It will depend on your state's worker's comp law. Each state varies. Each Workers comp agency has a webpage to answer your question. If you had medical bills from the fall, Workers comp will usually cover the medical cost if you filed a report with the employer when it happened.
