Might be eligible for Workman's Comp: If the surgery was due to working conditions you might be eligible for workman's compensation, but this is not the same as unemployment. To be eligible for unemployment, you have to be ready, willing, available and ABLE to work, and if you said you could not work, then you are not eligible.
If the injury occurred while on the job, you probably are eligible for Workers Comp. Whether not being able to work, otherwise, the claim would depend on the rules of your state's employment security office.
Might be eligible to collect unemployment:
I'm not certain that's entirely true. If he/she is laid up in bed, then in all likelyhood they would not qualify. It all depends on the nature of the injury/recovery. If, however, they were able to perform modified duty such as sitting in a chair doing data entry, then they would be willing to work. If their specific job does not provide for that type of light duty or there are no available positions to fill, he/she may be entitled to unemployment.
i.e. Willing to work, able to work, no work available. Provided they are still employed by the same company.
No, you have to be able and available for work.
No. You cannot claim to be looking for work if you are incapacitated from surgery. The taxpayers are not obligated to pay you to subsidize your recovery.
If what you are asking is "Can I collect unemployment after I have been back at work for weeks?" The answer is: No you can not.
It depends. If you are collecting unemployment, you need to report your earnings when you work.
it can work until it gets laid off, and then it can collect unemployment it can work until it gets laid off, and then it can collect unemployment
No you cant!
I do not believe that you can continue to collect unemployment if you refuse ANY legitimate offer of work.
YOu cannot receive unemployment if you return to work.
No because nobody is going to fire you because you have a cold. You have to be totally out of work to collect unemployment and not just out sick.
No. To be eligible for unemployment benefits, you must be available for work. If you are incarcerated, you are not available for work.
You can collect unemployment after state disability if you are healthy enough to return to work, and your employer terminated your employment during your disability. The termination can not be related to your job performance.
No you can't collect from both disability and unemployment at the same time. Disability provides income replacement if you are physically unable to work. Unemployment replaces income for those able to work, but out of work due to job loss.
