I was the person who wrote this, I found out that my auto insurance states in the policy that the other person has the option to use the insurance or go to court... I don't have a say in the matter. The bottom line is if you got insurance then you have to use it or tell them about the accident at least. Lessons learned: 1) if you settle out of court, you better get something in writing that says they are not going to claim any further damages later on. 2) Get a witness and always wait for the cops, they both will save you money and time and frustration if the other party is going to be crooked and claim more damages than really happened. 3) Finally and most important... be careful and SAFE and check all around your vehicle when you are going to do anything. Remember that one 5 second check can save you thousands of dollars, months of frustration, and even the untimely death of a loved one. Good luck to ya. :)

No. The reason for insurance is to avoid court. If the other party agrees, you can pay them out of pocket for their damages, however, your insurance company needs to know about the claim before you make a private settlement with the other person or you jeopardize your coverage if the other person comes back later for more.
