If you are a minor this is up to your mother or guardian if they have sole custody, which appears to be the way it is. Your father can demand all he wants, but depending on the reason why he was out of your life (it had better be a good reason) the courts may sway in his favor. If this should go to a court of law you have a right to decline to see your father even as a minor. If you are not a minor you have the right to decline to see your father. Short of your father being in prison for a terrible crime, he was abusive or a sexual predator then sometimes it's best to face your father and listen to what he has to say. You are young and sometimes things happen in people's lives and they may disappear and not come back into the family fold for even years. You need to see his side of things so you can honestly judge him and either accept him or get on with your life. Whether you like it or not he is part of you genetically. Either way you need to lay this to rest. Good luck! * Yes, any parent who has not had parental rights permanently terminated by the court can petition the court for visitaion or custody rights to a minor child. Pertinent matters such as lack of parental involvement will be addressed by the court at the time of the custody petition hearing and not before.

Can you move children out of state without permission of biological father in Pennsylvania?

No. Not if a family court has jurisdiction over the child and the father has visitation rights. If the parents were never married and there has been no court involvement or paternity established the mother can try to move. However, the father could file an action in court to establish his paternity, visitation rights and prevent the removal of the child from the state.

If the father of your child is an illegal immigrant and abandoned you when you were pregnant can he obtain vistation rights to his child in Virginia?

This is an extremely complexed issue, in that federal authorities have jurisdiction over immigration issues and state's establish domestic relation laws such as the custodial and/or visitation rights of biological parents. The "unlawfully present" father could file suit for visitation rights in the state court in which the child resides. However, the court is obliged to report all undocumented foreign nationals to the Department of Homeland Security. That being the case, it is not impossible for the father to be granted visitation, but he will most likely be targeted for detainment and deportation, as his whereabouts would have to be made known to the court when the suit for visitation rights was filed.

Can you as the custodial parent of an 12 year old not let your daughter to stay over in the house that her Father lives in with his girlfriend?

If the father has legal visitation rights-no. You can file a petition with the court to change visitation to show cause. You petition him to go to court where you tell the judge why you do not want, what you do not want and the judge will decide.

Can a child influenced by a controlling father refuse to return to full or shared custodial mother?

No. The father must obey the visitation order that was issued by the court that has jurisdiction over the case. If he continues to violate the visitation order and continues to exert negative influence on the child rather than trying to mitigate the situation, he could lose both any shared legal custody and visitation rights.

Can the father still have visitation if he is not paying child support but has a court order to pay?

Visitation and child support are two different issues. Legally you can't keep your child from visiting the father on that charge. Some fathers have gotten modified change of custody orders because the mother wouldn't allow visitation.
