If your boyfriend is 20 and you are 14 and you have sex can your parents press charges if you both said you are willing?

[Edit]

Answer

There are only two states where the age of consensual sex is 14, they are Hawaii, and S.C., but, they also have statutes pertaining to age descrepancies between the persons involved. Given that the young man is an adult in most states it is very likely he can and will be proscecuted with our without the parents of the minor filing charges. It would be advisable for the young man to seek legal counsel as soon as possible, and refrain from discussing the issue with anyone but a qualified attorney.

Answer

unless you are in the two states above, if the girls parents press charges...he's screwed. literally.

Answer

A common misconception is that an individual has to "press charges" for a prosecution to occur.

If a State or Federal law is violated, that is all that is required to seek prosecution against a suspect.

In jurisdictions that pursue a victim's affadavit (commonly preceived as "pressing charges") use this as a tool or device to determine the alleged victims level of cooperation in a prosection effort.

The question here is "Why were the parents letting a 14 year old socialize with a 20 year old?" 6 years age difference isn't much between mature adults, but it's a world of difference for the ages stated...

Answer

All states have laws pertaining to ALL relationships between adults and minors (yes.. in some instances those laws include parents). The male is an adult, the female is not, there are many laws both criminal and civil that could apply that do not involve a sexual relationship. Some would be, corruption of the morals of a minor, coercion or intimidation of an underaged person by an adult in authority, contributing to the deliquency of a minor, and so forth. Laws that define the committment of a crime can be enforced against the adult w/o the co-operation of the minor or the minor's parents or legal guardian. In addition, the parent(s) or legal guardian can seek civil "cure and remand" action against the adult concerning contributing issues.
