In the state of New York, there is no age in which a child can legally choose which parent to live with in a custody case. There is not set age at which a child gets to decide that,it's up to a judge and each child is different,and they ask alot of different questions,the older a child the more they can just express to a judge what they would like,the closer to being a teenager they will vocalize nice and loudly who they want to live with and if they don't get it,they are sure to make who they are sent to live with life a living hell.Sometimes it's best to give a kid what they want.I know in NH also there is not set age to emancipate a child either,and around age 14 they could be emancipated by the judge and then none of you can have a say what they do.
