I think in most states you would need parnetal consent. The 20 year old could in to trouble without it. Call the local court house or family lawyer that gives free phone consultations.

You cannot legally move out before the age of 18 without parental consent. South Carolinas Childrens Code defines a 'child' as anyone under the age of 18, and specifically states that running away from home is a 'status offense' (meaning something that is against the law for a child, but not for an adult).

If you leave home before the age of 18, your parents can report you as a runaway, and your boyfriend could get into trouble for taking you in. He could be charged with contributing to the delinquency of a minor and fornication (the living together and carnal intercourse with each other or habitual carnal intercourse with each other without living together of a man and woman, both being unmarried). I will admit that fornication is one of those laws thats rarely enforced, but it is still on the books, and I imagine if Mom and Dad caused a big enough fuss they could have it enforced. In addition, there could be other charges that he might be facing that Im unaware of. Do you really want to take a chance on the man getting into legal trouble and spending time in jail?

Technically it is illegal. However, the age of sexual consent laws of S.C. would not make such a relationship subject to prosecution. neither would S.C. compulsory education laws apply. Therefore, though not strictly legal it would be unlikely that the authorities would intervene, unless circumstances indicated coercion or exploitation. The parents however might be able to initiate "remand and cure" actions under applicable civil codes.

No, the legal age of majority for the state is 18.

A minor under the custody of any state agency must be released by the court even when said minor reaches the state's legal age of majority/

Not legally, as the age of majority for the state is 18. However, the state does not have laws that place such action under the automatic jurisdiction of law enforcement. The police must have a warrant issued by the court before they can take an absentee minor into custody and return him or her to the family home or to juvenile authorities. This requirement is not valid if the minor crosses state lines.

The age of majority in SC is 18 so no. However, if the minor leave the home she will not be a runaway and you can not force her to come back. That still leaves the legal age to move out without parental permission 18.

This is not legal advice and should not be relied upon as such. Consult the specific laws for the state and county in which you reside for the rules that apply. In most states, any 18 year old is considered an adult and is capable of deciding when and where they reside. They have the ability to contract for housing. SOME states allow minors to become emancipated under specific circumstances, but this is not just a matter of filling out some paperwork. A minor is the responsibility of their parents until such time as they reach the age of majority or are legally emancipated. The parents are required to provide for the support of their minor children. If the parents give permission, the minor can live in another location. Such permission does not relieve the parents of the responsibility to provide support. If the parents do not give permission, the minor can be considered a runaway. Charges may apply to individuals that aid and abet such runaways, particularly if they are under the age of consent. In some states it is my understanding that this is not enforced for 17 year olds that leave home. If you are subject to abuse, you should contact social services for your area. They will assist you in getting out of the bad environment and into a safe place.

yes; just as you can be tried as an adult criminally. If you move out on your own legally they can not stop you, although you will not be considered an adult until age 18.

No, they are 17 and have not reached the age of majority in South Carolina. Until that age the parents are responsible and make the decisions.
