The program "360 Share Pro" as well as others like it such as "Limewire" are not illegal in themselves. They simply allow users to share files. There are no central storage of files such as was the case of the old "illegal" Napster. Sharing files is not in itself illegal -- there are many legitimate files that can be shared between users. The fact that "360 Share Pro" can share legitimate files is why it is still available for download over the internet. In January 1984, the United States Supreme Court ruled in the case , "Sony vs. Universal City Studios" that it was legal to use Sony Betamax tapes to record copies of television programs for personal home use and thus ruled against Universal City Studios who sought to enforce copyright protection against such devices. The fact that such taping had a legal use was enough to allow them to be legally sold and distributed. The fact that they might be used for illegal uses was insufficient to deny customers the right to use them at all. In the same way "360 Share Pro" has a legal use and the fact that it might be used to copy illegal material is not sufficient grounds to deny users from using it at all. In 1992 the United States passed the "Audio Home Recording Act" which specifically made it legal to use any devices (or programs on devices) to copy and use audio works for noncommercial use (intended for home individual users).

In summary, the program "360 Share Pro" is legal to install and use. However, how an individual uses it could be either legal or illegal (i.e. cannot use for commercial purposes).
