The petitioner, who is working as an Assistant Anganbari Worker, has filed this petition for promotion to the post of Anganbari Worker on the basis of the Madhyama Examination certificate obtained by the petitioner from the Hindi Sahitya Sammelan, Allahabad in 2008.

The petitioner has been denied promotion by the order dated 1st November, 2010 on the ground that the certificate is not recognized.

Learned counsel for the petitioner submitted that the impugned order deserves to be set aside for the reason that the certificates issued by the Hindi Sahitya Sammelan, Allahabad is recognized. He also submits that no notice or opportunity was given to him before rejecting the representation.

Learned Standing Counsel appearing for the respondents has, however, submitted that for appointment on the post of Anganbari Worker, the requisite educational qualification is Intermediate or an examination equivalent to it, but the petitioner has obtained the Madhyama Examination certificate from the Hindi Sahitya Sammelan, Allahabad which examination is not equivalent to the Intermediate Examination and, therefore, the respondents are justified in rejecting the claim of the petitioner for appointment as Anganbari Worker.

I have considered the submissions advanced by the learned counsel for the parties.

The impugned order mentions that the Prathama, Madhyama or any other higher examinations are not equivalent to the High School/Intermediate Examination conducted by the Madhyamik Shiskha Parishad U.P. The claim of the petitioner has been rejected as she does not possess the requisite educational qualification for appointment on the post of Anganbari Worker.

The issue, therefore, that needs to be decided is whether Madhyama Examination of the Hindi Sahitya Sammelan, Allahabad is equivalent to the Intermediate Examination.

In Babu Ram & Anr. Vs. Deputy Cane Commissioner, Moradabad Division, Moradabad & Ors., (2000) 1 UPLBEC 422, the High Court held the Prathama Examination of the Hindi Sahitya Sammelan, Allahabad was not equivalent to the High School Examination and the cancellation of the promotion on this ground was held to be valid.

In this connection reference also needs to be mentioned to the decision of the Supreme Court in Rajasthan Pradesh V.S. Sardarshahar & Anr. Vs. Union of India & Ors., JT 2010 (6) SC 306 wherein the Supreme Court has held that certificate issued by the Hindi Sahitya Sammelan, Prayag remained recognised only upto 1967 and the relevant observations are as follows:-

"At the cost of repetition, it may be pertinent to mention here that in view of the above, we have reached to the following inescapable conclusions:-

(I) Hindi Sahitya Sammelan is neither a University/Deemed University nor an Educational Board.

(II) It is a Society registered under the Societies Registration Act.

(III) It is not an educational institution imparting education in any subject inasmuch as the Ayurveda or any other branch of medical field.

(IV) No school/college imparting education in any subject is affiliated to it. Nor Hindi Sahitya Sammelan is affiliated to any University/Board.

(V) Hindi Sahitya Sammelan has got no recognition from the Statutory Authority after 1967. No attempt had ever been made by the Society to get recognition as required under Section 14 of the Act, 1970 and further did not seek modification of entry No. 105 in II Schedule to the Act, 1970.

Thus, Madhyama Examination (Visharad) certificate said to have been issued by the Hindi Sahitya Sammelan is of no consequence.

It is, therefore, clear that the stand taken by the respondents that the Madhyama Examination (Visharad) certificate issued by the Hindi Sahitya Sammelan, Allahabad is not equivalent to the Intermediate Examination is correct. Such being the position, the claim of the petitioner for appointment on the post of Anganbari Worker has rightly been rejected.

There is, therefore, no merit in this petition. It is, accordingly, dismissed.

Hindi Sahitya Sammelan is recognised by the Govt of India by Act of Parliament as an institution of national importance for the promotion of Hindi language and literature in the non-Hindi speaking states of India.

It is granted funds by the Govt but not by UGC. Moreover, UGC does not consider it as a conventional university. And so , BA , BEd etc degrees cannot be conferred by Hindi Sahitya Sammelan. However, it can confer Indian titles like , Madhyama, Visharad, Ratna etc. Which is considered as equivalent to the familiar degrees but are not exactly the same as the later.

Regarding Shiksha Visharad of this institution, it is regarded as equivalent to BEd or BTC . But, Shiksha Vishrad is not a BEd / BTC degree: It should be called as Shiksha Vishrad only. As per rules, it cannot be equated. They are different identities.

Shiksha Vishrad offered by two Hindi institutions in Kerala which is affiliated to Hindi Sahitya Sammelan are recognised by the NCTE. However, they are not BEd or BTC and can be used only for an appointment of Hindi teacher in non Hindi state only.

Shiksha Visharad of Hindi Sahitya Sammelan offered by any other insitution in any other part of Kerala or any other state of India including UP / MP / Rajasthan is not recognised by the NCTE and therefore are regarded as fake degrees. They are actually not at all offered or awarded by the Hindi Shaitya Sammelan directly, but some (actually many) coaching classes, agents and correspondence institutions make fake marksheets and degrees at heir own level and sell them in the name of the prestigious Hindi Sahitya Sammelan and this is the main reason which defames this important institution of India which is constantly working for the welfare and promotion of our National Language, Hindi.
