If the couple is separated without a court order specifying support terms WCI the funds would not be available to the spouse until such an order is granted. However, WCI settlements and benefits can be garnished for child support and in some instances spousal maintenance(alimony)if a court order is already in place. It is assumed if the couple resides together the spouse should receive the same financial/material benefits resulting from the settlement as does the one receiving the monies.
