Usually both parties are responsible for tax debts during the marriage. A spouse might not be responsible for taxes owed before the marriage.

Husband dies leaves unpaid income taxes filing jointly is wife responsible if there is no estate in Indiana?

Joint filers are both responsible for the entire tax bill. If the unpaid taxes are from a year that the couple filed jointly, the wife is fully responsible for any unpaid taxes unless she can meet the qualifications for innocent spouse relief. After the filing deadline, a joint return cannot be amended to separate returns. If there are unpaid taxes from 2008, the wife can still file a separate return for 2008. If a joint return has been filed for 2008, they have until April 15, 2009 to amend.

Is the surviving spouse responsible for deceased spouse's federal income tax?

I take it that the two of you filed separate returns and kept your funds separate. You are probably not responsible for your deceased spouse's federal income tax. However, your deceased spouse's estate is responsible for his or her federal income tax. That is if there is enough money in the estate to pay the taxes. Otherwise, you may need a good tax lawyer.

What if your spouse refuses to pay taxes on earned income?

I suggest not filing a joint return. Using the Married Filing Separately filing status will not allow you to claim some tax benefits and you won't have the benefits of combining your income, but it will save you if your spouse is audited. If you file jointly, you will be fully responsible for the taxes on the omitted income. Filing a joint return creates something called "joint & several liability" which means you are both responsible for the entire tax liability, even if it's later adjusted because one spouse omitted income or committed tax evasion. Read IRS Publication 971 to find out the difficulty of not being held responsible for your spouse's actions. That's why I recommend not filing a joint return with your spouse. The benefits will not be worth the cost if they are caught evading taxes.

How do you file your income tax married jointly?

You can file your federal taxes jointly if you are married. Even if your spouse is unemployed, filing jointly means he or she is still responsible for any outstanding taxes due should you not pay.

Marital assets Military division of 50 of retired pay Does ex-spouse have to pay taxes on money received or can member pay all taxes and split retirement?

If the divorce decree states the 50/50 split and the ex spouse has submitted a dd 2293 application for former spouse payments from retired pay, and DFAS (defense finance and accounting service) has approved the split, then the ex spouse is responsible to pay income tax. If DFAS is not involved and the former member is paying the ex spouse then the former member is responsible for taxes. I believe this is the correct answer.

What is the most your spouse can make without you claiming her on your income taxes?

On your MFJ income tax return you do not have a choice about claiming your spouse. Your spouse would not be claimed as a dependent exemption on your MFJ income tax return. You have one exemption for each spouse on the MFJ income tax return and all gross worldwide income is combined on the married filing joint income tax return.
