Answer
The answer is very much a "depends". There is not consistent, clear law on this and a lot of it depends on where it takes place, what exactly was done while using the connection, the technology understanding of the local law enforcement and legal community, etc. You will find cases where individuals have been prosecuted for doing this but again, not on a consistent basis. Bottom line is that it is certainly not worth the risk of finding out how your local situation works, you may not like the answer.
