Knowing the state you live would be helpful :) There are some states that have laws against adultery. Technically, if you live with someone else while you are still legally married, then it would be adultery.

There are no doubt laws still "on the books" in some states that pertain to the issue of adultery, but given the general atmosphere of today's society they would not be subject to prosecutory actions. It would however give the other spouse a strong argumen for whatever he sought concerning the dissolution of the marriage; such as custody of minor children, spousal maintenance, and so forth.
