Difficult as it is to believe Virginia is one of the few states which still have existing cohabitation laws and sometimes enforce them. Virginia Code 18.2-345 makes the living together of unmarried persons a Class 3 misdemeanor for a first offense and if the offense is repeated it becomes a Class 1. If someone chose to make trouble it is quite possible they could alert authorities to the situation. It is not possible to predict exactly what action authorities might take if any. I Googled the code but the first part was crossed out (not sure why that didn't copy with the text) Has this law been changed?

I assume that the "ex-boyfriend" is also the father of the child. If you believe that he lied to gain custody, you can file a motion/petition for a custody re-hearing and be prepared to demonstrate that he lied, and that you are a 'fit' mother to have custody of the child.
