To be able to own a full auto MP5, it would have to have been manufactured, imported, and NFA tax stamped prior to the passage of the Gun Control Act of 1968. If enough parts were replaced to make it 922r compliant, then this 922r compliance conversion would have to have been done, and it would have to be NFA tax stamped prior to the passage of the Firearm Owners Protection Act of 1986.

An FFL dealer who has the appropriate Class 3 Special Occupational Tax Stamp may purchase and even have one imported, provided they obtain a law enforcement letterhead authorising the purchase as a "dealer sample".

Semi automatic carbine clones of the MP5 are legal to own in Florida. They must be 922r compliant if manufactured after 1989, and have a barrel length of no less than 16 inches, unless it's NFA registered as a short-barreled rifle.
