Best chances for HIPAA to apply are if you go from a group plan to a group plan. Evidentally, individual to group and nothing to group are loop holes, so they can probably get out of it, or make you wait a certain amount of time.

According to a Federal law that I found on the internet, GROUP health insurance cannot consider pregnancy a pre-existing condition if they currently have maternity coverage. However, this law does not apply to INDIVIDUAL health insurance. So, if you've changed jobs, and you now have a GROUP health insurance plan, then there is a good chance that you may be covered.
