Only if you do not consent to terms and conditions related to the spyware, whether it be packaged with software your installing hidden somewhere in the terms of conditions of the software you install or elsewhere, collecting any information on a user without their knowledge or consent is illegal.

New laws introduced in the UK now recognise Stalking as a form of harassment. Stalking therefore, could be construed as Spying. Spying when used in stalking form is illegal and can be (if proven) prosecuted for.

Spying on our movements without our knowledge, for example installing software to a persons mobile phone or remotely installing a trojan horse to a computer, deploying a tracking device to a persons car, hiding a recording device within the persons home / office - all without the owners knowledge or permission is a form of spying without consent.

Spying on an enemy using satellite and / or cloaking technology for the protection and security of a country is not illegal.

So, spying can be considered both legal and illegal in various forms - but it all depends on how this is applied to any given situation.

Spying is not technically legal. You can spy on your own but you can land into serious trouble as well.
