Common area is the terminology used to describe real estate assets owned by a common interest community, owned in common by all owners, as opposed to assets completed owned by individual member owners, such as their individual condominium units or homes.
Since the common area real estate is owned by the association, of course the local building code applies, but the area is not, by definition, open to the public.
If you are a developer and purchase the land, you can work with a common-interest community savvy attorney to develop the conditions, covenants, reservations and restrictions for land-use that you want for your plat. Then you can build your building and sell units based on the Public Offering Statement required in your state. If yours is an apartment building, again, you can work with a CIC-savvy attorney to convert your building to condominiums. Key is process and your ability to meet all the requirements for this project.
Not necessarily. But common knowledge is considered to be in the public domain.
A consequence of building condominiums downtown is increased gentrification and rising property prices, which may lead to displacement and limited affordable housing options for lower-income residents. Additionally, increased population density can strain existing infrastructure and public services, such as traffic congestion and overcrowding in schools and public transportation.

It depends. You can film people without their knowledge in public places or places where there is no expectation of privacy. Filming a person in their home without their knowledge would probably be considered criminal stalking.

Public schools are mainly subsidized by tax dollars. It is considered a "common good" for people to have free public education.
