There is a famous quote from a Supreme Court Justice (I forget which one) who said "The constitution means what I say it means". There are many different ways of interpreting the constitution, which, after all, does not exactly spell out all the major implications of its own content. All members of the US government are required to agree to uphold the US Constitution, and I have no doubt that they all believe that they are doing so, including members of Homeland Security. It is possible that if you or I were working in Homeland Security, we might take a different approach.
