"If you own a family business are exposing everything you own to being taken in a lawsuit. See a lawyer to explain how this can easily happen. I am not a lawyer. I have run a business. The workmen comp, can help cover the medical of an employee hurt on a job....years of treatment for a back- injury could bankrupt your company over time. A large settlement could close you quick. You and your husband can be covered for the same type of on the job injury or exclude yourself and husband. Getting insurance only on the others. If I contracted your firm to come to my business, and do a Job..big or Small I don't require you to prove you have work comp n your people and one of them gets hurt on my property since you don't have it, I can be held liable for their injury, and have to pay. That is why so many schools, colleges, businesses want work- comp certificates from you ...before you can even bid a job."

I think the above person is talking about liability insurance, which is different from workmans comp. If all of your employees are family, you don't need workmans comp. If one or more employees are not related, then yes it is required.

According to Entrepreneur magazine's "Ultimate Guide to Worker's Compensation Insurance," Colorado requires Comp for ALL employers with 1 or more employees. I would add that some of the worst battles can unfortunately come from family members, and that these are the people you should want to protect more than anyone. Even if you don't think your family would ever make a claim against you, consider how a serious injury might affect their finances and their future health insurability. Further, lack of Comp insurance does not mean you're not liable - it only means you've waived your best defense against a lawsuit, and have decided to cover the cost of any claims yourself - possibly driving the cost of your firm's health insurance, if you provide it, way up as well.

That depends on the law of your individual state. Some states dont require comp for businesses with a very small number of employees, but most do. Check with your local bar association for someone to ask about a pro bono matter, and they will be able to refer someone who can answer that for free.

You can contact your state Workers Comp bureau for this answer. Even if the state allows an exemption, you will remain liable so be sure you can write a big check if you opt to NOT carry coverage. If you want to exercise an exemption, at least carry Occupational Accident coverage on your employee, or be willing to write a big check!

Aren't these the people you want to protect more than anyone? Aren't these the people who will expect you to do the right thing by them? Even if your state provides an exemption (check with your state) because of your company size or employee type (officer, etc.), the benefits of Comp, like lost wages, lifetime medical for work related injuries, are so worthwhile. Would your business survive if you lose their work, and you have to pay their medical claims, pay to retrain them in new work if they can't do the job they do for you because of an injury? What if they're going to the bank for you in their job and are killed in a car wreck - would they have family, like minor children who would suffer the loss? Please carry Comp.
