Some states allow employers to self-pay worker injuries, waiving WC insurance.
Such employers can be sued for negligence even if they pay for employee med costs and lost wage benefits. An employer providing workers comp can NEVER be sued for negligence or any liability except the WC benefit set by state law.

Surgeons are business people who can make decisions about which cases to handle based on any criteria they deem reasonable. Some doctors don't accept Workers' Comp or some major medical plans at all. Thankfully, many do.
I know that if you are on workers comp, they don't want you to work at all. Even if it is a cashier job, because that will mean that you can work, but you are not working.
It depends on your state. For example, Texas is the only voluntary state for Workers' Comp. BUT, it, like all states, says that if you don't carry the coverage you remain liable for your workers AND you lose your sole remedy (which means people can sue your company for workers' injuries - not only the worker, but his spouse, kids...) Not all states say you have to cover 1099 workers, but many do - including the voluntary Comp state of Texas - if your subcontractors don't have coverage (or remain liable.)

In this state you can not generally collect workman's comp pay if you are injured on a second job and still are able to work on your first job if that is your main job. Your second job would be responsible for all medical bills for the injury on your second job. That would be it. To get workers comp, you must swear that you are unable to work. My father is a pastor and has never received any type of pay or benefits. It is essentially like owning your own business. As the owner of a store you would not expect the workers to pay comp.same for church. Some churches will pay the pastor but its all up to the individual church. I'd imagine those that pay their pastor might voluntarily offer comp but there is no law requiring it. Hope that helps
Report it to your Employment office and also to Workman's Comp. There isn't much they can do, but at least it's report (also send a registered letter about your complaint because it's then on file should you have any problems in the future.) It makes me laugh at all the warnings given to the public about Identity Theft yet what do they do ... they send your Workman's Comp in regular mail (instead of Registered Mail where you have to sign) and they do this in Canada with new Driver's Licenses and Credit Cards. From now on have your Workman's Comp. checks put into "direct account" (into your savings or checking account.) You will receive all info on your bank statement so you know you are getting the checks. I get my Canadian Pension and Old Age Pension checks sent right to an small interest baring checking account at my Credit Union and thus, it stops Identity Theft.
