Sixty families in a MH park on L.I.NY. asked about buying the park and were told it was not for sale. The park was sold out from under us in March of this year. How can we buy park when sold in secret?In: Property Law |

when the seller sold the park, he obviously had a bona fide purchaser who was willing to pay the asking price...since there is now a new owner of the land, there will be a deed recorded in the county clerks office for the property, which would be either nassau county (hempstead) or suffolk county (riverhead), assuming it is not in the city...legally, the families are only tenants under the law, and have VERY limited rights in and to the use of the land...the seller was under no legal obligation to deal with any of the families as they are only tenants, and had not offered any kind of a purchase offer to the seller...my suggestion...go to the county clerks office, look in the index books for the name of the seller as GRANTOR, see who he sold it to, and approach them to see if they have an interest in flipping the property...the purchaser may have bought the property as a business investment and is looking forward to the income he will get as the landlord, and may have no intention of selling
