It was legal. Under the law during that time, a provisional government is allowed to be set up if the acting one (The Council of Assiniboia in this case) was not recognized by the people. Louis Riel and the other Métis did not recognize this government, so they set up their own provisional government.

At the time just before the Red River Resistance, there was no government. Riel wanted to maintain order in the Red River Settlement and negotiate the terms under which Rupert's Land and the North-western Territory would become part of Canada.

Interesting question because Canada claims it was illegal and since might makes right, winners write the history, those with gold writes the rules.....

The answer would have to use some moral grounds. The Hudson Bay company sold the land claimed by Riel's government to Canada. BUT that land included people who have very legitimate legal and moral claims to the land. Rightful claims that were ignored in the sale.

When Canada refused to acknowledge those rightful claims it was completely legal for the people to create their own government to administer their own lands, particularly since they were under military threat from Canada.
