When an individual is sentenced to a term in jail or prison it is assumed that he or she has been allowed all their civil rights as defined under the current laws of the state and/or federal government and/or the US Constitution.

The person who is arrested has the right to remain silent and to have legal representation and if they cannot afford private counsel the court will appoint a PD.

The person who has been incarcerated generally has the right to appeal with the exception of some specific circumstances (if the person was currently on parole, violated a standing court order, etc.)
